SJ Energy and Water Performance Ordinance (BPO)
San Jose BPO requires owners of non-residential and multifamily buildings that are 20,000 ft² and over to report their annual energy consumption and water use annually. BPO requirements are the followings:
Annual Energy and Water Benchmarking - Due May 1st Annually

Benchmarking Reports: All non-residential and multifamily buildings over 20,000 ft² are required to submit their buildings' energy benchmark report through the ENERGY STAR Portfolio Manager website annually.

Benchmarking Report Submission Fee: Invoice of $150 benchmarking report submission fee is sent to building owners and is due 30 days of the invoice day.
Beyond Benchmarking Requirements - STARTING in 2023!
Starting 2023, buildings over 20,000 ft² will be subject to the new Beyond Benchmarking Requirements, which requires buildings to meet certain Energy and Water Performance Standards. Buildings not meeting the standards will comply by one of the following options:

Conducting an ASHARE Level II Energy Audit and Water Audit;

Performing an Energy Retro-commissioning and Water Retro-commissioning; or,
-
Adopting Efficiency Improvement Measures
